These Terms of Service ("Terms") govern access to and use of the Benchmark platform and related services ("Platform"). Benchmark is a trading name of ALWD Limited ("Benchmark", "we", "us", or "our").
By accessing or using the Platform - including by browsing this website, by using the free demo mock without an account, or by creating an account - you agree to these Terms. If you do not agree, you should not use the Platform.
If you access the Platform through a training provider under a separate written agreement between that provider and Benchmark, that agreement governs the provider's use of the Platform and prevails over these Terms to the extent of any conflict. These Terms continue to apply to your own use of the Platform except where that agreement says otherwise. See section 1.
Benchmark is an exam emulation and assessment platform that allows training providers to create and administer simulated examinations, and allows their students to undertake them. Benchmark may also provide a limited free demo mock and optional AI-assisted marking or feedback tools.
These Terms apply to:
Training providers contract with Benchmark separately. The relationship between Benchmark and a training provider - including pricing, service levels, ownership of the provider's content, and data protection responsibilities - is governed by a separate written agreement between Benchmark and that provider (the "Provider Agreement"), not by these Terms. Where any conflict arises between the Provider Agreement and these Terms in relation to a provider's use of the Platform, the Provider Agreement prevails.
Students access the Platform to use content and examinations made available by their training provider. Students do not bring their own examination content to the Platform. A student may be required to create login credentials to access the Platform, but doing so does not change the fact that the content, examinations, and assessment are administered by, and under the responsibility of, their training provider.

Benchmark is an independent platform and is not affiliated with, endorsed by, or approved by the Solicitors Regulation Authority (SRA) or any official examining body.
The Platform is intended as a learning and assessment simulation tool only.
Benchmark does not guarantee:
You must be at least 18 years of age to create an account and use the Platform independently. Users under 18 may only access the Platform with appropriate supervision or authorisation from a parent, guardian, or accredited training provider.

You are responsible for all activity occurring under your account.
Where your account is created to access a training provider's examinations and content, your access may also be subject to rules or conditions set by that provider, and the provider may control, suspend, or revoke your access to its content.
You must not share accounts or permit unauthorised access to the Platform.
Examinations, questions, materials, and other content made available through the Platform by a training provider ("Provider Content") belong to that provider or its licensors. Ownership and permitted use of Provider Content are governed by the Provider Agreement. You may use Provider Content only as part of your authorised use of the Platform, and you must not copy, reproduce, distribute, or share it.
When you use the Platform you may submit answers, responses, and related material ("Submissions"). You retain ownership of your Submissions.
You grant Benchmark a non-exclusive, royalty-free licence to host, store, process, and display your Submissions for the purpose of operating the Platform, administering and marking examinations, providing feedback to you and, where applicable, to your training provider, and maintaining the security and integrity of the Platform. This licence does not extend to using your Submissions for any other purpose.
We do not use your Submissions or Provider Content to train artificial intelligence or machine learning models. Where AI-assisted features are used, content is processed only to generate output for that session, as described in section 5.
You are responsible for ensuring you have the rights necessary to make your Submissions. You must not submit content that:
Benchmark may provide optional AI-assisted marking, scoring, or feedback tools through third-party providers.
AI-generated outputs are provided for informational and educational purposes only and may be inaccurate, incomplete, or misleading.
AI outputs should not be relied upon as:
Benchmark may modify, suspend, or remove AI features at any time without notice.
The Platform may autosave examination progress and related activity data during use.
While Benchmark takes reasonable steps to maintain the Platform, availability and performance may be affected by maintenance, technical failures, internet disruption, third-party services, or other factors outside Benchmark's control.
Users are responsible for ensuring they have appropriate internet access, devices, and backups where necessary.
You must not:
Benchmark may suspend or terminate access to the Platform at any time where it reasonably believes a user has:
Benchmark may remove Submissions or Provider Content where reasonably necessary to protect the Platform or comply with legal obligations.
All rights in the Platform, including software, branding, interfaces, design, and Benchmark-created materials, are owned by or licensed to Benchmark.
Except as expressly permitted, no part of the Platform may be copied, reproduced, distributed, sold, or exploited without prior written permission.
Benchmark may rely on third-party providers, including hosting, payment, analytics, and AI service providers.
Benchmark is not responsible for outages, errors, or failures caused by third-party services.
To the fullest extent permitted by law:
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any statutory rights you have as a consumer (including under the Consumer Rights Act 2015) that cannot lawfully be excluded.
Use of the Platform is also governed by the Benchmark Privacy Policy.
Benchmark may modify the Platform or these Terms at any time.
For material changes, Benchmark will endeavour to provide reasonable advance notice by email where a valid email address is held. Updated Terms will otherwise take effect when published on the Platform.
Continued use of the Platform after changes are published constitutes acceptance of the updated Terms. If you do not agree to updated Terms, you should discontinue use of the Platform.
These Terms are governed by the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction over any dispute arising from these Terms or the use of the Platform.
