These Terms of Service ("Terms") govern access to and use of the Benchmark platform and related services ("Platform"). Benchmark is a trading name of ALWD Limited ("Benchmark", "we", "us", or "our"). By creating an account, accessing, or using the Platform, you agree to these Terms.

1. About Benchmark

Benchmark is an exam emulation and assessment platform that allows training providers to create and administer simulated examinations, and allows users to undertake them.

Benchmark may also provide limited demo materials and optional AI-assisted marking or feedback tools.

Benchmark is a trading name of ALWD Limited, a company registered in England and Wales under company number 14458561, whose registered office is at 124 City Road, London, EC1V 2NX.

2. Important Disclaimer

Benchmark is an independent platform and is not affiliated with, endorsed by, or approved by the Solicitors Regulation Authority (SRA) or any official examining body.

The Platform is intended as a learning and assessment simulation tool only.

Benchmark does not guarantee:

  • examination outcomes;
  • similarity to any real examination;
  • accuracy of marking or feedback;
  • uninterrupted availability of the Platform.

3. Eligibility and Accounts

You must be at least 18 years of age to create an account and use the Platform independently. Users under 18 may only access the Platform with appropriate supervision or authorisation from a parent, guardian, or accredited training provider.

You must:

  • provide accurate account information;
  • keep login credentials secure;
  • use the Platform only for lawful purposes.

You are responsible for all activity occurring under your account.

You must not share accounts or permit unauthorised access to the Platform.

4. User Content

Users may upload examination materials, answers, documents, and other content ("User Content").

You retain ownership of your User Content.

By uploading User Content, you grant Benchmark a non-exclusive, worldwide, royalty-free licence to host, store, process, display, and use that content for the operation, maintenance, improvement, and provision of the Platform.

You are solely responsible for ensuring that you have all rights and permissions necessary to upload and use User Content.

You must not upload content that:

  • infringes intellectual property rights;
  • is unlawful, abusive, defamatory, or fraudulent;
  • contains malware or harmful code.

5. AI-Assisted Features

Benchmark may provide optional AI-assisted marking, scoring, or feedback tools through third-party providers.

AI-generated outputs are provided for informational and educational purposes only and may be inaccurate, incomplete, or misleading.

AI outputs should not be relied upon as:

  • official marking;
  • professional advice;
  • definitive assessment outcomes.

Benchmark may modify, suspend, or remove AI features at any time without notice.

6. Platform Availability and Exam Data

The Platform may autosave examination progress and related activity data during use.

While Benchmark takes reasonable steps to maintain the Platform, availability and performance may be affected by maintenance, technical failures, internet disruption, third-party services, or other factors outside Benchmark's control.

Users are responsible for ensuring they have appropriate internet access, devices, and backups where necessary.

7. Acceptable Use

You must not:

  • reverse engineer, decompile, or attempt to extract source code from the Platform;
  • scrape, automate, or systematically extract Platform data;
  • copy or reproduce Benchmark materials, interfaces, or demo examinations;
  • interfere with Platform security or functionality;
  • attempt unauthorised access to accounts or systems;
  • use the Platform to conduct security testing without written permission;
  • upload malicious software or harmful content.

8. Suspension and Termination

Benchmark may suspend or terminate access to the Platform at any time where it reasonably believes a user has:

  • breached these Terms;
  • engaged in cheating or misconduct;
  • infringed intellectual property rights;
  • compromised Platform security;
  • used the Platform unlawfully or abusively.

Benchmark may remove User Content where reasonably necessary to protect the Platform or comply with legal obligations.

9. Intellectual Property

All rights in the Platform, including software, branding, interfaces, design, and Benchmark-created materials, are owned by or licensed to Benchmark.

Except as expressly permitted, no part of the Platform may be copied, reproduced, distributed, sold, or exploited without prior written permission.

10. Third-Party Services

Benchmark may rely on third-party providers, including hosting, payment, analytics, and AI service providers.

Benchmark is not responsible for outages, errors, or failures caused by third-party services.

11. Limitation of Liability

To the fullest extent permitted by law:

  • the Platform is provided "as is" and "as available";
  • Benchmark disclaims all warranties, representations, and guarantees;
  • Benchmark shall not be liable for indirect, consequential, incidental, special, or economic losses;
  • Benchmark shall not be liable for loss of data, examination performance, business interruption, lost profits, or reputational harm;
  • Benchmark shall not be liable for inaccuracies in AI-generated outputs or simulated examination content;
  • Benchmark's total liability arising from or connected with the Platform shall not exceed the amount paid by the user to Benchmark in the preceding 12 months.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any statutory rights you have as a consumer (including under the Consumer Rights Act 2015) that cannot lawfully be excluded.

12. Privacy

Use of the Platform is also governed by the Benchmark Privacy Policy.

13. Changes to the Platform or Terms

Benchmark may modify the Platform or these Terms at any time.

For material changes, Benchmark will endeavour to provide reasonable advance notice by email where a valid email address is held. Updated Terms will otherwise take effect when published on the Platform.

Continued use of the Platform after changes are published constitutes acceptance of the updated Terms. If you do not agree to updated Terms, you should discontinue use of the Platform.

14. Governing Law

These Terms are governed by the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction over any dispute arising from these Terms or the use of the Platform.
